Capitalized terms have meanings defined hereunder.

10. General Data Protection Regulation (GDPR) Privacy

The Company may process Personal Data under the following conditions:

  • You have given your consent for processing Personal Data for one or more specific purposes.
  • Provision of Personal Data is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof,
  • Processing Personal Data is necessary for compliance with a legal obligation to which the Company is subject,
  • Processing Personal Data is necessary in order to protect your vital interests or of another natural person,
  • Processing Personal Data is related to a task that is carried out in the public interest or in the exercise of official authority vested in the Company, and
  • Processing Personal Data is necessary for the purposes of the legitimate interests pursued by the Company.

In any case, the Company will gladly help to clarify the specific legal basis that applies to the processing, and in particular whether the provision of Personal Data is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

  • You have the right to access, update or delete the information the Company has on you. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you. This also enables you to receive a copy of the Personal Data the Company holds about you.
  • You have the right to have any incomplete or inaccurate information the Company holds about you corrected.
  • This right exists where the Company is relying on a legitimate interest as the legal basis for our processing and there is something about your particular situation, which makes you want to object to our processing of your Personal Data on this ground. You also have the right to object where the Company are processing your Personal Data for direct marketing purposes.
  • You have the right to ask us to delete or remove Personal Data when there is no good reason for us to continue processing it.
  • The Company will provide to you, or to a third-party you have chosen, your Personal Data in a structured, commonly used, machine-readable format. Please note that this right only applies to automated information which you initially provided consent for us to use or where the Company used the information to perform a contract with you.
  • You have the right to withdraw your consent on using your Personal Data. If you withdraw your consent, the Company may not be able to provide you with access to certain specific functionalities of the Service.

You may exercise your rights of access, rectification, cancellation and opposition by contacting us. Please note that we may ask you to verify your identity before responding to such requests. If you make a request, the Company will try our best to respond to you as soon as possible.

13. Facebook

The Company is the Data Controller of your Personal Data collected while using the Service. As operator of the Facebook Fan Page [https://www.facebook.com/tymtractors.kr/], the Company and the operator of the social network Facebook are Joint Controllers.

The Company uses the Facebook Insights function in connection with the operation of the Facebook Fan Page and on the basis of the GDPR, in order to obtain anonymized statistical data about our users.

14. California Consumer Privacy Act (CCPA) Privacy

CCPA provides eligible California residents with specific rights with respect to our collection, retention, and use of Personal Data. This California Privacy Rights section supplements this Privacy Policy and applies solely to eligible residents of California as of January 1, 2020. Any terms not defined in this section have the same meaning as defined in the CCPA.

You must be properly notified which categories of Personal Data are being collected and the purposes for which Personal Data is being used.

  • You have the right to request that the Company provide certain information to you about our collection and use of your Personal Data over the past twelve (12) months. Specifically, you have the right to request disclosure of the categories of your Personal Data and specific pieces of your Personal Data we have collected about you over the last 12 months. Upon the submission of a verifiable consumer request we will disclose to you:
      • The categories of your Personal Data collected,
      • The categories of sources from which your Personal Data was collected,
      • The business or commercial purpose for collecting or selling Personal Data,
      • Categories of third parties with whom the Company shares Personal Data, and
      • The specific pieces of your Personal Data we collected.
  • You have the right to request the deletion of your Personal Data that have been collected and maintain, subject to certain exceptions. Once the Company receive and confirm your verifiable consumer request, the Company will conduct a reasonable search of our records in order to locate any Personal Data we have collected about you that is eligible for deletion, and delete such Personal Data.
  • The Company does not sell personal information. However, the service providers we partner with (for example, our advertising partners) may use technology on the Service that “sells” personal information as defined by the CCPA. You may have the right to opt-out and request that the Company not sell your Personal Data.

To exercise this right, you may submit “Do not Sell my Personal Data” request via email to the Company.

  • The Company will not discriminate against you for exercising any of your privacy rights. Unless permitted by applicable law, the Company will not:
      • Deny you goods or services,
      • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties,
      • Provide you with a different level or quality of goods or services. and
      • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
  • Under California Civil Code Section 1798 (California’s Shine the Light law), California residents with an established business relationship with us can request information once a year about sharing their Personal Data with third parties for the third parties’ direct marketing purposes.

If you are a California resident, you can email or call us to exercise your rights under the CCPA.

Request to exercise your rights under the CCPA require verification of your identity, and may be made only by you, your parent or guardian (if you are under 18 years of age), a person to whom you have given power of attorney pursuant to California Probate Code sections 4000 to 4465, or an authorized agent that is registered with the California Secretary of State.

If a parent or guardian is submitting a request on behalf of a minor, the parent or guardian must submit proof they are the parent or guardian of the subject consumer, and must verify the consumer’s identity.

Your verifiable consumer request must provide sufficient information that allows the Company to reasonably verify that you are the person about whom the Company collected Personal Data or that you are an authorized representative of such person.

The Company will not respond to your request or provide you with Personal Data if the Company cannot verify your identity or authority to make the request and confirm the Personal Data relates to you.

The Company will disclose and deliver the required information free of charge within 45 days of receiving your verifiable request. The time period to provide the required information may be extended once by an additional 45 days when reasonably necessary and with prior notice.

The Service may contain links to other web sites that are not owned or controlled by the Company. The Company is not responsible for the privacy and security of these web sites. This Privacy Policy applies only to this Service.

 

16. Changes to this Privacy Policy

The Company may update our Privacy Policy from time to time. The Company will notify you of any changes by posting the new Privacy Policy on this page.

The Company will let you know via email and/or a prominent notice on the Service, prior to the change becoming effective and update the "Last updated" date at the top of this Privacy Policy.

By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole in or in part, please stop using the website and the Service.
